1. Acceptance of Terms

By downloading, installing, or using JustYap (“the Software”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software.

2. Description of Service

JustYap is a desktop voice-to-text application that converts speech to text using local AI models and optional cloud transcription services. The Software is available for Windows, with macOS and Linux support planned.

3. Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Accounts are limited to a maximum of 3 devices.

4. Subscription Plans & Billing

JustYap offers multiple subscription tiers (Yapper, Certified Yapper, Legendary Yapper) billed monthly, annually, or as a one-time lifetime purchase. All payments are processed through LemonSqueezy, which acts as the Merchant of Record.

4.1 Free Trial

New users receive a 7-day free trial with full access to all features. No credit card is required to start the trial.

4.2 Refund Policy

We offer a 7-day money-back guarantee on all subscriptions. If you are not satisfied, contact us within 7 days of purchase at support@justyap.app for a full refund. Lifetime purchases are eligible for a refund within 14 days. For full details, see our Refund Policy.

4.3 Usage Limits

The Legendary Yapper plan includes 600 minutes per month of managed cloud transcription. Usage resets at the beginning of each billing period. Unused minutes do not roll over.

5. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from a purchase within 14 days without giving any reason, in accordance with the EU Consumer Rights Directive. However, you acknowledge that:

  • Digital content: By downloading and using the Software during the withdrawal period, you expressly consent to the immediate provision of digital content and acknowledge the loss of your right of withdrawal upon full download.
  • We voluntarily offer a 7-day money-back guarantee on all subscriptions and a 14-day money-back guarantee on lifetime purchases, which exceeds the minimum refund obligation for digital content.

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the Software
  • Use the Software for any unlawful purpose
  • Attempt to circumvent subscription or usage restrictions
  • Share your account or license key with others
  • Use the Software to process audio recordings of others without their consent

7. Intellectual Property

JustYap and its original content, features, and functionality are owned by JustYap and are protected by international copyright and trademark laws. The Whisper AI model is developed by OpenAI and used under the MIT License.

8. Third-Party Services

JustYap integrates with third-party services including Groq, OpenAI, Supabase, Vercel, and LemonSqueezy. Your use of these services is subject to their respective terms of service and privacy policies. For details on how data is shared, see our Privacy Policy.

9. Disclaimer of Warranties

The Software is provided “as is” without warranties of any kind. Transcription accuracy depends on audio quality, language, accent, and other factors. We do not guarantee 100% accuracy.

10. Limitation of Liability

To the maximum extent permitted by applicable law, JustYap shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Software. This limitation does not apply where prohibited by law, including mandatory consumer protection laws in the EU.

11. Termination

We may terminate or suspend your account if you violate these terms. Upon termination, your right to use paid features ceases immediately, but local transcription continues to work. You may cancel your subscription at any time through your LemonSqueezy customer portal.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or in-app notification at least 30 days in advance. Continued use of the Software after changes take effect constitutes acceptance of the new terms.

13. Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law provisions.

For consumers within the European Union, mandatory consumer protection laws of your country of residence apply where they provide a higher level of protection. You may bring legal proceedings in the courts of your country of residence.

The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.
